Estate Recovery is a law that allows the State of Michigan to make claims against assets from individuals who receive Medicaid assistance to pay for nursing home care. The state can seize homes, vehicles, jewelry and other assets to offset what the state is paying for nursing home care.
The law went into effect on September 30, 2007; however, the State of Michigan did not establish procedures to comply with this law until July 1, 2011.
Once a Medicaid recipient dies, the State of Michigan becomes a creditor of his or her assets that go through probate.
